NY Judge Won’t Postpone Enforcement Of Trump’s Penalties

New York Judge Arthur Engoron rejected an attempt by former President Donald Trump to delay enforcement of the penalties issued in his civil fraud case.

While Trump asked to delay enforcement of the penalties by 30 days, Engoron said that Trump’s lawyers did not give a justifiable reason.

“You have failed to explain, much less justify, any basis for a stay. I am confident that the Appellate Division will protect your appellate rights,” Engoron said in his ruling.

The ruling foils hopes by Trump’s legal team to propose a counter-judgement to the one proposed by New York Attorney General Letitia James, which saw Trump get fined almost $355 million and banned from doing business in the state for three years.

On Wednesday, Trump attorney Clifford Robert asked Engoron to allow the proposal of a counter-judgement. According to Robert, not allowing a counter-judgement from Trump’s team “would be contrary to fundamental fairness and due process.”

Another letter the Trump lawyer sent to Engoron accused the judge of violating normal procedure with the pace at which the process is being made to go.

The letter read, “The Court’s direction that it sees ‘no need for a motion or conference,’ because the proposed Judgment ‘exactly tracks the’ February 16 Decision, ignores the fact that the proposed Judgment expressly states that a motion has been made, which is simply wrong. The Attorney General has not filed any motion on notice, nor moved to settle the proposed Judgment; her unseemly rush to memorialize a ‘judgment’ violates all accepted practice in New York state court.”

Engoron’s decision comes after James threatened to seize Trump’s properties in New York if he does not produce the money to pay the fine he was slammed with.

Speaking to ABC News, she said, “If he does not have funds to pay off the judgment, then we will seek judgment enforcement mechanisms in court, and we will ask the judge to seize his assets.”

“We are prepared to make sure that the judgment is paid to New Yorkers, and yes, I look at 40 Wall Street each and every day,” she added, referring to the Trump Building which is located on Wall Street by the New York Stock Exchange.
